So Eon BS commented on the Maryland Wear and Permit application tutorial video. He said, I just completed my wear and carry class December 1st. How long do I have to submit the application to state police?
Andrew
Well, so I guess he could be asking two different things here. So first, the certification is good for two years from the date of issuance. So when you go to the training class and you get your certificate and they sign it, it's good for two years. The other bit, and I'm guessing maybe he's asking when should he submit, state police wants it 90 days out from your expiration. If you do it too soon, if you did it a year in advance or many months in advance, they're going to kick it back and they're going to say that it's not up for renewal and so they're going to decline it. So that 90 day window, right, give or take, that's the sweet spot. That's where you want to be.

But if you're an initial applicant, your fingerprints are only good for 30 days. So it's important that if you got your fingerprints done immediately after you completed your course, that you do not let your fingerprints expire.

So fingerprints, there are three schools of thoughts on fingerprints and probably more. The state police has a SOP from 2010 that's still in effect that says that the fingerprints are actually only good for 72 hours, which we know isn't true. State police has been denying people who have been submitting with fingerprints that are older than two weeks old. But if you call and you ask, you'll get 30 days and 90 day answers. So what we tell people is within two weeks you're safe. More than two weeks, you're rolling the dice.

I guess he's asking what's the difference between a rapid fire switch or a binary trigger or a force reset trigger? Andrew, in the eyes of the law, is there any guidance on those different types of devices that do essentially the same thing?

This is a brand new law and on top of things, the vast majority of your assistant state's attorneys wouldn't know what any of this stuff is even to begin with.

So if you are ever in a situation where this is a serious question and you have been arrested and charged under the statute, number one, get a lawyer as soon as possible. Number two, let's get a good expert who can explain that this doesn't qualify and let's see what the state's able to do back.

So this was from our Halloween episode and if you haven't seen that, go and check it out. But it was basically a foot pursuit that turned into a suspect. Carjacked. Someone essentially tried to take over their vehicle and had a weapon and the officer shot 'em through the windshield. So quick decisions sometimes have to be made. Not every decision is perfect, but given the circumstances, the officer felt that that was the appropriate thing to do.

22 is not a primary defensive round. It hasn't been. It's not going to be anytime probably in our lifetime. There are so many better options out there now he says a backup gun. If I have to carry a backup gun, I would still like it to be in a appropriate defensive caliber. So if I feel the need for that, I'm going to carry another nine millimeter that maybe is a little bit smaller, but I don't want to risk my life on the chance that it might work.

How bad have things gotten that it's the point you're using your backup gun. If it's to that point, I would pull out a 1911 if that's the point that things have gotten to.

Well, look, most people want backup guns that are going to be smaller than their primary gun in the sense that it's something that they could always just have knocking around. But you're going to get a 22, it's going to be essentially a similar size to one of the larger calibers. There's no reason not to have a nine millimeter. I'm not a fan of 22 for any type of self-defense purpose. If you do that, you're the dice. I wouldn't do it. Andrew, what about a 1911 and 22?

I'm very familiar with the economic theory of Mr. Engles and Marx, IE Marxism. I'm aware of their manifesto. I've even read it. I also understand the years it's been implemented in a number of countries from the Eastern block to the far East and generally in almost every one of these occasions, even down in Cuba, private firearms use and maintenance is generally very well restricted. Universal conscription almost always exists and certainly they're using firearms against their own citizens as they massacre them in the streets and run them over with tanks. So yes, I'm very well aware of what occurs in Marxist countries.

So the first World War ended in 1918. I believe it was November of 1918 and yes, the 1911 was in service during that time. Maybe not to the degree it was during World War ii. I know that production was still was much less than it was during World War ii, but it was in fact in service.

Well, look, Maryland is doing what Maryland does as are some other liberal states and I get it. I feel your pain. But unfortunately Maryland does what Maryland does.

You need to have plaintiffs who are willing to go and seek redress in the United States District Court for the District of Maryland and take their cases from there up to the Fourth Circuit and then Bon review and be willing to go all the way to the Supreme Court. And that's how you fight these battles and win them.

How many dollars are you willing to put behind it? Yeah,

And you've got to be arrested, charged, convicted, and then get an appeal. Right?

That is one way to do it. Another way is you can try and get a preliminary injunction, challenge the constitutionality of the law on its face, but any of these processes take years and that's why we still have ongoing litigation from Senate Bill one, which is passed several years ago at this point.

I know the states are sovereign, but why do we have to take lawyers and a billion dollars to them to check on laws from any state and USA that are clearly infringement before they check into it?

I'm wearing a lovely suit today, if not for these billion dollars, how am I going to afford things like this? But no seriously, you are raising a very valid point that it is unfortunate that protecting the Second Amendment costs a lot of money. The Supreme Court hears very few cases every year. They cherry pick which cases they're going to hear. They're mainly concerned with disputes between the circuits where the fourth circuit will say something is allowed, the 11th circuit will rule differently and they want to resolve these splits between the circuits. Do I wish the Supreme Court would take more Second Amendment cases? Absolutely. But they're very judicious in selecting which cases they take and whatever cases they take. Once again, it unfortunately takes years before you get your day in the Supreme Court. Alright, next question

So I think the experts that person's referring to is going to be the folks that are reviewing the data from firearms cases and those people I'm guessing are going to be appointed or hired by some sort of appointing authority, Andrew

And some would say who are cynical, their expert authority is what can they say negative about the Second Amendment? What is their track record of saying negative things about the Second Amendment and how eloquent are they in saying unkind things about the Second Amendment?

So they may actually be people that are coming in with preconceived notions and are looking for data as opposed to trying to find the data.

This is a new law that has just come into effect and it is yet to be tested in so far as I'm aware, no one has been convicted of it and made an appeal to the Maryland Appellate Court or the Maryland Supreme Court seeking a review of the expanse of the law. No one has in so far, as I'm aware, sought an injunction in the United States District Court or any of Maryland circuit courts to review this. So this is still an evolving area of law. I would be very careful because no one wants to be the test case. Alright, next question

On the Maryland State Advisory email video, Steven Hood 29 48 commented, I'm a resident of West Virginia but work in Maryland. I was interested in getting an out-of-state Maryland handgun license, thus being able to carry a firearm legally in Maryland, Virginia and West Virginia. So the entire route I traveled to and from work, what class, if any, is available for me to take in order to CC in Maryland as an out-of-state resident? Also, am I correct in recalling that only open carry is legal in Virginia without a license?

Alright, so as far as the other state laws go, I'm not even going to touch on that because that's not what we do for the most part as it applies to Maryland, you can get a Maryland handgun permit as an out-of-state resident. You would need to go through the two-day class, 16 hours and the range qualification component. You would need to submit your application, be fingerprinted, photographed, and then have that application reviewed and approved in order to get your Maryland carry permit. As you're saying, CC conceal carry permit. But as far as the other states, you would need to contact those states to find out what their process is.

In Maryland, we have a plethora of gun laws. I struggle to imagine, although I'm sure someone will come up with a wonderful hypothetical where an individual will be committing a criminal act already and the straw that will break the camel's back will be this trigger. The bigger issues, I think we should be focusing our prosecutorial resources against criminals using firearms, committing crimes of violence. I don't think we need additional regulations to target otherwise. Law abiding citizens, once again, it would be illegal under the federal code to possess one of these devices. I am unaware of a plethora of these devices being held in the state of Maryland that are not already being prosecuted by the federal government. I'm against additional laws simply for the sake of having additional laws. Alright, moving right along

On our Maryland handgun qualification license application video, Aman Khan OB six YR commented, I'm stuck on file size. My files are smaller than five megabyte and still get a message that files more than five megabyte are not allowed. I don't have FBI statement. Can I still submit my documents?

So to the first part of your question, if you are submitting files that are of the correct file size and they're not working, you're going to need to call the licensing division and get some technical support from them. As far as the FBI statement, you need to print it, fill it out in your own writing, scan it back into your application and send it in that way. If you're still having some problems, you can contact us and we'll see if we can help you out. Next question.

So if you're exempt from the training portion, you still have to submit your application. So when you go into your application in the dropdown menu under exemptions, you're going to choose whatever exemption you're claiming, whether it be a military exemption or a law enforcement exemption or whatever, and you won't have to submit a training certificate potentially, but you will have to still submit the application, wait for it to be approved and wait for your permit to come before you're able to carry the gun.

So actually you can carry lots of places in Maryland Senate Bill one added some additional complications, but there were some injunctions that took place that took care of some of that. So the color that I used is the Korean War OD Green, which is darker more olive than the more Brown World War II paint. I don't remember exactly what it was called. I got some through Midwest military and I also got some through Kaiser Willies and Kaiser Willies gets it from Midwest military. So if you call them and you ask for the Korean War era od they'll know what you're talking about

If a state law is not consistent with a federal level right as determined by the US Supreme Court, the state law stands until it's challenged on a state by state basis. It seems if the supreme law of the land says you can't deny someone of a core human right state laws to the contrary should immediately fall. Is that the same principle as what the abortionists argued after Roe v Wade was overturned?

It is unfortunate that yes you are describing our federal legal system in a nutshell states all the time, all 50 of 'em plus the District of Columbia plus our overseas territories and commonwealths often on a local level, enact ordinances, laws, statutes that are unconstitutional, often on their faces they stand until brave citizens come forward and challenge them in the appropriate venue. Often the United States District Court, the proponent of these legislation, they obviously feel otherwise and you are going to have a contested hearing for a judge and where one would point out the unconstitutionality of the proposed or enacted legislation and then the judge would make a decision, you would ask for an injunction that the law could not take effect until it is finally resolved. But sometimes in cases the judges allow it to stand until it is finally decided on its merits and then whoever loses state or the petitioner is probably going to take an appeal to the appropriate circuit court. They are going to render a decision on the case. Once again, a process that often takes years. In that case, they can always ask for an in banc where the whole circuit will hear it and once again, the losing party has an opportunity to petition for ROI from the Supreme Court. Once again, this takes forever. Does it move too slowly? Certainly. But this is the system we have. Alright, thank you Andrew. Alright, next question

Also, you can pass all the laws you want, you just make crime high and victims of crimes even higher. But I'm not a politician, I have a brain. So without getting into all the theatrics, stripped lowers if they're purchased from a manufacturer, are serialized. So when you register 'em, they are registered to you under that number. If you're referring to 80% lowers that someone would make on their own, if they are not serialized or registered well then there would be no way to trace them.

So they're talking about the particular firearm that was used in the testing where they were showing lawmakers how the Glock switch and stuff works. My suspicions are, again, I don't have any information in front of me, but my suspicions are that this was an evidence firearm and likely it came out of the property room and it was test fired as a demo for these people. But I can't say for certain

If you do put down a reference, I know they were doing both in person and then during covid they were doing phone interviews. I also know that people that had very clean records, some of their references weren't even being contacted. So I think it really just depends and it could go one way or the other. Alright, so if you have an HQL, whether you're a vet or not, you're still going to have to submit for your carry permit. Now, if you're a vet and you meet the requirements under the law DD two 14 and so forth, then you're training exempt, but you're still going to have to submit your packet, your application for a carry permit. If you don't meet the criteria for the training exemption, you would still have to go through the two day where and carry permit class. The opposite. If you had your wear and carry permit, you could use that to get an HQL without having to pay extra money and get extra training, but not that way. So next question

I've been working on his hip thrusts to be the power bottom from error, helping you decide the best carry handgun, Luger or 1911 John T block, 1911 has a hammer and it's a little hard to field strip and you carry a cocked and locked. Oh, the horror. If you're not familiar with the platform, youngster shot up. When adults are talking, it's different than what you are used to. That does not make it bad or wrong. The real question is what platform is the individual comfortable with can hit reliably with and carry comfortably. For some that's a 22 or a 38 or whatever. This guy's punctuation is terrible. But anyway, some folks with bad arthritis can handle more than a three 80 a CP, but every caliber can work because nobody likes to leak. In the words of Walt Roush, well-known trainer and ex-co, remember the first rule of gun fighting is to have a gun.

Well, I think having a gun is great and useful and important, but if I'm going to have a gun, I would much rather have a gun that's going to be as effective as possible. With that said, yes, maybe there are people that can only shoot a 22 because of tremendous arthritis or something like that. And for those individuals you just need to understand that you're under gunned and you're at a disadvantage. So you better be accurate. You better get multiple rounds on target and you better have an exit strategy. That's the best I can give you.

On our Maryland Deadly Defense pro tip discussion video Tiger 24 kicks. Commented, I'm in Perryville, Maryland in my apartment complex. I had two individuals come to my apartment and tried to enter. I'm not far from Baltimore. People are saying they're doing home invasions. A few people homes were broken into. They tried to enter my apartment, I went out the following week and got an AR 15. I heard I'm supposed to retreat to the furthest part of the house and tell them to leave. But I'm also hearing using an AR 15 isn't good for home defense because the court likes to prosecute those cases more than shotgun for home defense.

So a couple things here. One, you are not required to retreat to the furthest portion in your home. Castle doctrine allows you to stop anyone from entering or attempting to enter your home that you believe is coming into a try and commit a felony or some sort of crime of violence or surprise or something like that. So you do not have to retreat inside of your home, outside of your home. You do as far as the AR 15 goes, you're shooting a 5, 5, 6 round I'm assuming, and that's going to go some distance. So you run into some issue of potentially having over penetration and that's going to be an issue for your neighbors and other people in the home as far as law enforcement more aggressively prosecuting you because you're using an AR 15 versus a handgun. I don't see that being the case. Andrew,

This is a perfect segue. We were just in Cecil County where we had a murder case where myself and my partner were defending an individual. He used a handgun, but we have had several self-defense cases in Cecil County. I do not think the elected state's attorney would care about the weapon used under these circumstances without further aggravating or mitigating factors. If you had an AR 15 and you happen to have acquired a 30 round magazine and you unleashed all 30 rounds into the alleged perpetrator, or if you were a very poor marksman, and as Dwayne alluded to, you had all kinds of over penetration and especially if you're in an apartment where someone may be on the other side of the wall from you and you were just as one commenter earlier said, spraying and praying, sure you're setting yourself up for legal jeopardy. But in terms of the AR 15 itself, painting a target on yourself, if you used it in a legitimate case of self-defense, that would be the least of my worries.

Alright, so Andrew, you said that that is a segue into actually the case that we alluded to in the very beginning of the episode. So would you care to tell everyone about it?
Vincent
My partner and I, we had to go back to Cecil County for another case. We love coming up there once a year to do a self-defense case. We had an individual, a homeowner in his driveway. There was a gentleman who came onto his property armed and there was a critical self-defense situation that occurred. The state's attorney's office elected to prosecute him, charge him with first degree murder, and he unfortunately was incarcerated for six months. We were able though, however, to convince a jury of 12 individuals good and true citizens of Cecil County, that there was reasonable doubt and the jury found him not guilty. He did several things that I think helped them reach their decision. He was cooperative with law enforcement. Cooperative doesn't mean making a statement, but cooperative, meaning not acting like a belligerent idiot. He secured the firearm, put it away from himself, kept his hands up and was very cooperative with the state police when they responded in their requests. He was not indignant or rude or attacking them. He was polite throughout the encounter and did everything they asked him to do. When he was eventually charged, he surrendered himself and throughout everything we had him do in this case, he was focused on explaining to the jury as well and completely as possible about how scared he was, about why he felt he was in danger and why this was the appropriate action to take.

Alright, so if I was to ask you for bullet points, takeaways, best practices from this particular case, and I think you kind of already said it, but simplify it for the viewers. Things that you can take away from this case that our viewers can use to help protect themselves if they're in a similar situation,

If they feel comfortable, don't be afraid to render aid to your former assailant. Cooperate with the police in terms of locating the firearm, identifying yourself to them, and not acting like an app.
