5 Reason Legal Gun Owners Go To Jail by US Law ShieldHi, I am Kirk Evans, president of US Law Shield, and I'm here today to talk about the five main reasons that we have seen why lawful gun owners end up in jail.

1. Number one is the bad guys don't tell the truth. Frankly, in my 20 plus years of practice, I have never seen a circumstance where the police arrive on the scene and the bad guy says, yes, officer, I was harassing, intimidating, and robbing so-and-So, and that's when he pulled his gun. No, frankly, the criminals do not tell the truth. We've even had extreme cases where the criminals told the officer that our member shot up their own car to make it look like they were attacked first. That member was later cleared by the grand jury.

2. Number two, police officers often do not know the law. As amazing as that sounds, not every officer knows every intricacy about the laws that impact gun owners.

We've had one case where a member was charged with a crime in writing, and that crime did not even exist on the books in Texas.

3. Number three, individuals often do not know the law. We have seen time and time again, folks carry their gun to a place where they're not permitted to do so, or use their weapon in a circumstance where they're not permitted to do so. For example, we have received countless phone calls from folks who have used their gun in a mere road rage incident, completely prohibited under Texas law. Yet many folks have the mistaken belief that they're permitted to do so.

4. Number four, the role of the police is not always to determine right at the scene who's right and who's wrong. Many times the police investigate arrest everyone involved and let the judicial system determine who was right and who was wrong.

For example, we had one member involved in a shooting where he fired the bad guy fired, and the police arrested both sides and charged both sides with the crime even though our member had done nothing wrong.

5. Number five, people are just that. They're people. Many times members of law enforcement are educated, raised, or trained under different circumstances than you or I, and might not be as favorable toward gun ownership. We had one member facing a home invasion. She drew her gun and called 9 1 1 incredibly. The 9 1 1 operator told her to put her gun away and wait for the police to arrive. That's simply an example of someone who's either trained or raised differently than you or I. As you can see, even a law abiding gun owner can find themselves in hot water with the legal system.
